Mumbai High Court gags Google again for abusive blogs



Mumbai cardiologist moves the Hon’ble High Court after coming across defamatory (blogger) blogs; seeks Rs 10 lakh as damage from Google!

Hosting of defamatory blogs has come under the court scanner for the second time this year, with Bombay High Court last week restraining Google from hosting a defamatory blog against Mumbai-based cardiologist Dr Ashwin Mehta, director of cardiology, Jaslok Hospital. The HC had, in October, restrained the website from carrying defamatory blogs against a journalist.

Dr Mehta moved court after he came across over 20 defamatory blogs on the website. “The blogs contain innuendoes that are defamatory to me. The statements impute as if I am guilty of professional misconduct, and it is clear that the same is motivated and prima-facie malicious,” says the complaint filed by Dr Mehta. He also claimed compensation of Rs 10 lakh as damages. “The articles are meant for bringing me into ridicule, scorn and shame in the eyes of the general public. I have suffered incalculable harm to my name and reputation,” Dr. Mehta’s complaint said.

Google, on the other hand, in its affidavit said, “Google India does not have any connection with or responsibility towards getting local content for Google Inc. USA. Google Inc and Google India work as different units and function independently. Google India does not have control, operate or provide any local or other support for Google Inc’s services.” The affidavit also said that Google Inc has replied to a notice from Cyber Cell of the Mumbai police, after Dr Mehta had lodged a complaint against them.
